TheCreatorRoster Terms of Service

  1. Introduction

    1. These Terms of Service (“Terms”) govern your access to and use of TheCreatorRoster, including our website, mobile apps, and any content, features, or services offered on or through the platform (collectively, the “Services”).
    2. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
    3. These Terms constitute a legally binding agreement between you and TheCreatorRoster. Your access to and use of the Services is also subject to TheCreatorRoster’s Privacy Policy, which is incorporated herein by reference.

  2. Eligibility

    1. You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Services.
    2. By using the Services, you represent and warrant that you meet these eligibility requirements.
    3. If you are accessing or using the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
    4. TheCreatorRoster may, in its sole discretion, refuse to offer the Services to any person or entity at any time.
    5. Eligibility with respect to jurisdiction: Your use of TheCreatorRoster is governed by the laws of the jurisdiction in which you reside or access the Service—whether that be your state, province, city, country, or other legal entity. This Service is not available in any region where its use is forbidden or restricted by law. If you create an account or use TheCreatorRoster while located in a jurisdiction that prohibits or limits such use, you will be violating local laws and these Terms, and your account may be suspended or terminated immediately without prior notice. You agree that TheCreatorRoster shall not be held responsible if applicable laws prevent or restrict your participation. Furthermore, TheCreatorRoster makes no express or implied guarantees regarding your legal right to access our Services, and no individual claiming an association with TheCreatorRoster is authorized to provide such assurances. We reserve the right to limit or deny access to the Service in any jurisdiction.

  3. Account Registration

    1. To access certain features of the Services, you may be required to create an account.
    2. You agree to provide accurate and complete information during the registration process and to keep your account information updated.
    3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
    4. You agree to notify TheCreatorRoster immediately of any unauthorized access to or use of your account.
    5. TheCreatorRoster reserves the right to suspend or terminate your account at any time for any reason.

  4. Content on TheCreatorRoster

    1. TheCreatorRoster allows users to share commentary and media about their favorite Creators and Celebrities or related topics.
    2. You are solely responsible for any content you post, share, or otherwise make available on or through the Services (“User Content”).
    3. You represent and warrant that you have all necessary rights and permissions to any User Content you submit and that it complies with these Terms and all applicable laws.
    4. You retain all ownership rights in and to your User Content. However, by submitting User Content to TheCreatorRoster, you grant TheCreatorRoster a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Services and TheCreatorRoster’s business.
    5. You understand and agree that TheCreatorRoster may, but is not obligated to, monitor or review User Content. TheCreatorRoster may, in its sole discretion, remove or disable access to any User Content that violates these Terms or that we deem objectionable.

  5. Prohibited Content

    1. TheCreatorRoster maintains a zero-tolerance policy for child sexual abuse material (CSAM) or child pornography. All content posted to TheCreatorRoster must depict individuals who were over the age of 18 at the time of production.
    2. If you seek any form of CSAM or child pornography, you must not use the Services.
    3. Any content that exploits, abuses, or endangers children is strictly prohibited and will be reported to the appropriate authorities.
    4. You agree to report any images that appear to depict minors to help uphold our zero-tolerance policy.
    5. Additionally, TheCreatorRoster prohibits the following types of content:
      1. Illegal content
      2. Content that infringes on the intellectual property rights of others
      3. Hate speech or content that promotes violence or discrimination
      4. Spam or other unsolicited content
      5. Content that impersonates another person or entity
      6. Content that violates the privacy of others
      7. Content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
      8. Content that promotes or encourages illegal or harmful activities

  6. Content Monitoring and Removal

    1. TheCreatorRoster reserves the right, but has no obligation, to monitor and remove any content that violates these Terms or that we deem objectionable.
    2. We may also suspend or terminate accounts of users who repeatedly violate these Terms.
    3. We may cooperate with law enforcement authorities in the investigation of any suspected illegal activity.

  7. Copyright and Intellectual Property

    1. Copyright Ownership: All content, trademarks, logos, and intellectual property associated with TheCreatorRoster are owned by the Company or its licensors.
    2. User Content: By submitting content, you warrant that you either own the rights or have obtained all necessary permissions to post such content on TheCreatorRoster.
    3. DMCA Compliance: We respect the intellectual property rights of others and will respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
    4. Submitting a DMCA Notice: If you believe that your copyrighted work has been infringed on TheCreatorRoster, please provide our designated Copyright Agent with a written notice that includes:
      1. Your name, address, telephone number, and email address;
      2. A description of the copyrighted work claimed to have been infringed;
      3. A description of the location of the infringing material on TheCreatorRoster, including a link if applicable;
      4. A statement, under penalty of perjury, that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
      5. Your electronic or physical signature.

    6. Infringers: We reserve the right to terminate accounts of infringers in appropriate circumstances.

  8. Disclaimers

    1. The Services are provided “as is” and without warranties of any kind.
    2. We do not guarantee that the Services will be uninterrupted, error-free, or free of harmful components.
    3. You use the Services at your own risk.
    4. To the fullest extent permitted by law, TheCreatorRoster disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

  9. Limitation of Liability

    1. To the fullest extent permitted by law, TheCreatorRoster and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.
    2. In no event shall TheCreatorRoster’s total liability to you for all damages, losses, and causes of action arising out of or relating to these Terms or your use of the Services exceed the amount paid by you, if any, for accessing the Services.

  10. Indemnification

    1. You agree to indemnify and hold harmless TheCreatorRoster and its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Services or your breach of these Terms.

  11. Termination

    1. We may terminate your access to the Services at any time for any reason, with or without notice.
    2. Upon termination, your right to use the Services will immediately cease.
    3. All provisions of these Terms that by their nature should survive termination—such as those relating to ownership, warranty disclaimers, indemnity, and limitation of liability—shall remain in effect.

  12. Dispute Resolution

    1. You agree that any cause of action arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

  13. Entire Agreement

    1. These Terms constitute the entire agreement between you and TheCreatorRoster relating to your use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written.

  14. Changes to These Terms

    1. We may update these Terms from time to time.
    2. We will update the “Last Updated” date at the top of these Terms.
    3. Your continued use of the Services after the posting of any changes constitutes your acceptance of those changes.
